Chapter 11 Bankruptcy
If your small business is struggling, a Chapter 11 bankruptcy case may be the optimal choice. This type of bankruptcy is often referred to as a “reorganization” bankruptcy. The process involves a reorganization of your business affairs, debts, and assets, while you remain in control and continue running the day-to-day operations of your business.
The coronavirus pandemic has hit small businesses hard, forcing many of them to close, open at limited capacity, or file for bankruptcy protection. Prior to the passage of the CARES Act, which went into effect on March 27, 2020, filing for Chapter 11 bankruptcy was not an option for most small businesses due to the cost and complexity of the process. The passage of the Small Business Reorganization Act (SBRA) streamlined the Chapter 11 bankruptcy process, allowing small businesses to file and receive the benefits of restructuring under bankruptcy without giving up control of the day-to-day operations. It also eliminated the requirement of the business owner to pay quarterly U.S. Trustee’s fees.
Chapter 7 Bankruptcy
A business that files bankruptcy under Chapter 7 will pay its debts by the liquidation of its assets. There are no exemptions in business bankruptcy, which means everything is sold. The creditors are ordered by priority of debt and paid accordingly. With the assistance of a bankruptcy attorney, filing for business bankruptcy under Chapter 7 is quite simple and methodical: the assets are sold and creditors are paid. Chapter 13 Bankruptcy
The most important thing about a chapter 13 case is that it will allow you to keep valuable property, especially your home and car which might otherwise be lost if you can make the payments that the bankruptcy law requires to be made to your creditors. In most cases, these payments will be at least as much as your regular monthly payments on your mortgage or car loan, with some extra payment to get caught up on the amount you have fallen behind. You should consider filing chapter 13 in the Orlando plan if you:
- Own your home and are in danger of losing it because of money problems.
- Are behind on debt payments, but can catch up if given some time.
- Have valuable property which is not exempt, but you can afford to pay creditors from your income over time.
- You have a second mortgage that may be eliminated if your house is worth less than what you owe on your first mortgage.
